Rule 32
Other procedures to be followed when imposing an immediate penalty
: (1) If an immediate penalty has to be imposed according to sub-section (1) of section 39 of the Act, the inspection officer shall issue an order form in the format as per schedule-10 and deliver one copy to the person liable to pay such penalty and make compensation for the same. will fall
(2) While determining the amount of the fine according to sub-rule (1), the inspection officer shall determine the nature of the offense committed by the concerned person, its amount and the adverse effect on the consumer, subject to subsection (1) and (2) of section 39 of the Act.
(3) When ordering a fine according to sub-rule (1), the inspection officer shall specify the amount of the fine, the place where such fine is to be paid (bank name, account number) and the last date for filing the fine. (4) If the concerned person refuses to understand the order given by the inspection officer according to sub-rule (1) or if there is any obstacle in the work, the inspection officer can make the order of such penalty to be delivered to him with the help of the local police.
(5) The inspecting officer shall keep the record of the immediate penalty related order made by him in accordance with Section 39 of the Act in the format as per Schedule-11.
